Terms of Service – Alpha and Omega Property Services Pty Ltd (Australia)

Welcome to Alpha and Omega Property Services Pty Ltd (“Alpha and Omega”, “we”, “us”, or “our”). We provide subscription-based and one-off home maintenance services through our website and online platform (the “Service”). These Terms of Service (“Terms”) govern your use of the Service. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Your Privacy

We respect your privacy. Please refer to our Privacy Policy for details on how we collect, use, and protect personal information.

2. Access and Use of the Service

2.1 Service Description

Alpha and Omega provides subscription-based and on-demand home maintenance services. Services may be delivered by our staff or by subcontracted trusted professionals. We coordinate, manage, and oversee these service providers.

We aim to deliver all services with reasonable care and skill in accordance with the Australian Consumer Law (ACL). Where third-party trades or contractors are involved, Alpha and Omega coordinates their work but is not responsible for their conduct beyond what is permitted by law.

2.2 Registration Obligations

Certain features may require you to register and provide accurate, up-to-date information. You must be at least 18 years old to use the Service.

2.3 Account Security

You are responsible for safeguarding your account login. Notify us immediately of any unauthorised access.

2.4 Service Modifications

We may modify, suspend, or discontinue parts of the Service without liability. We will provide notice where reasonably possible.

2.5 Data Storage and Limits

We may set data or usage limits and may delete inactive accounts with prior notice.

3. User Conduct

You agree not to use the Service for unlawful or harmful purposes. Prohibited actions include:

  • Uploading malicious, harmful, or unauthorised content

  • Interfering with platform operations

  • Violating Australian law

  • Impersonating any individual or organisation

  • Collecting or misusing data from other users

4. Subscription Fees and Billing

4.1 Fees

You agree to pay all applicable fees for your subscription plan. Payments are processed through Stripe. By using Stripe, you accept their terms and policies.

4.2 Recurring Billing

Subscriptions are billed monthly in advance. You authorise automatic recurring payments until cancelled.

4.3 Price Changes

Pricing may be updated with 30 days’ notice. Continued use after changes constitutes acceptance.

4.4 Refunds and Cancellations

You may cancel at any time. Refunds are handled in accordance with the Australian Consumer Law. If services are not delivered with due care and skill, you may be entitled to a remedy.

5. Consumer Guarantees

Our services come with non-excludable guarantees under the ACL. You are entitled to:

  • A refund or replacement for major service failures

  • Compensation for reasonably foreseeable loss

  • Remedies when services aren’t delivered with reasonable care and skill

6. Intellectual Property

All content, branding, software, and intellectual property belong to Alpha and Omega or our licensors. You may not copy, modify, distribute, or reverse-engineer any part of the Service unless expressly permitted.

7. User Content

You retain ownership of content you upload but grant us a licence to use, modify, store, and distribute it as necessary to operate the Service.
We may remove content that violates these Terms.

8. Third-Party Services

Our platform may link to third-party sites or services. We are not responsible for their content or conduct. Use at your own discretion and comply with their terms.

9. Copyright Complaints

If you believe your copyright has been infringed, contact us at info@alphaandomega.com.au with:

  • Your contact details

  • A description of the copyrighted work

  • Details of the infringing material

  • A statement of good-faith belief

We will review and take appropriate action.

10. Dispute Resolution

We aim to resolve concerns quickly and fairly.

If unresolved, you may seek assistance from relevant consumer protection bodies or tribunals in your state (e.g., VCAT in Victoria).

11. Limitation of Liability

To the extent permitted by law, Alpha and Omega is not liable for:

  • Indirect, incidental, or consequential losses

  • Loss of data, revenue, or profits

  • Delays, interruptions, or access issues

Where liability cannot be excluded under the ACL, it is limited to either:

  • Re-supplying the services, or

  • Refunding the amount paid

12. Termination

We may suspend or terminate your account for violating these Terms.
You may cancel your account at any time.
Upon termination, access to your account and data may be removed.

13. Governing Law

These Terms are governed by the laws of Victoria, Australia.
You submit to the exclusive jurisdiction of the courts of Victoria.
